Upset system (PC) TIVO harddrive ?

I just got out of a little hot water here, some website surreptitiosly loaded a
couple of programs on my PC. What I like to see at Ctrl+Alt+Del is 7 things
running. Today there were 9, and this thing got slow.......................

I did a scanreg /restore back to two days ago and it's OK now, but......

I've done ALOT of downloading. I decided it was time for a backup, but we are
talking about an 11GB backup. This system has been cloned from a 10GB to a 40GB
to an 80GB.

Now here's the question: during the time I used the 40GB it was always in DOS
compat (real) mode. I posted about this before, read the responses (thanks
again) and nothing worked. Could NOT get it out of that mode , and I did notice
the speed. Now the system is fine, running the 80GB it's not doing it, but I
decided I would use the 40GB for the backup. I disconnected the CD and the
burner and hooked it up.

First I formatted it through Windows, rebooted and it was still stuck in real
mode. Then I used the (98se) startup diskette and removed the partition, then
installed a new partition not marking it active, which is wise if you want to
use it as a "roving" harddrive. Much faster than burning. Now I have completely
re-fdisked and formatted the drive and it is still stuck in real mode. How can
this be ?

I cloned the 10GB to the 40GB using the Maxtor utility, by the time I saw
device manager it was too late, somebody told me to re-clone it, but that
wasn't going to work. There was no NOIDE key in the registry, what's more when
I cloned it to the 80GB the problem disappeared ! (that was NortonGhost2003)

Could it be a hardware thing ? This is a Maxtor DiamondMax Plus 8 6E040L0,
touted to be able to handle the demands of use in a TIVO or DVR, and quietly. I
can attest to it's quietness, even out of the PC case right in front of you,
you rarely can hear anything, possibly a slight sss-sss-sss.

There are no errors on this drive, surface checks fine, but it just doesn't use
protected mode drivers. I thought those were for the controller, not the drive.
As far as the controller it has no problem seeing the whole 80GB, runs it in
protected mode and this drive is even newer, so could it be because the 40GB
was MADE for a TIVO or DVR ?

The thing has a three year warranty which is not up yet, but if a replacement
will have the same problem I'd rather not go through finding another place for
the data. Whaddya think, is it defective or is it because it's desgned for a
specific purpose ?
